1. Acceptance of Terms
By accessing or using RetireSmart AI at retiresmart-ai.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
RetireSmart AI is an online tool that helps users compare retirement destinations based on estimated costs of living, visa requirements, tax treaty information, currency exchange rates, and other factors. The Service is available in a free tier and a paid Pro tier.
3. Subscriptions and Billing
Pro subscriptions are billed on a monthly ($8.50/month) or annual ($75.00/year) basis. By subscribing, you authorise us to charge your payment method through our payment processor, Stripe, on a recurring basis.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You may cancel at any time through your Stripe customer portal or by contacting us at support@retiresmart-ai.com.
- Cancellations take effect at the end of the current billing period. No partial refunds are issued for unused time.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
4. Refund Policy
Refunds are issued at our sole discretion. If you believe you were charged in error, contact us within 14 days of the charge at support@retiresmart-ai.com and we will review your request.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- Cost estimates, exchange rates, visa requirements, or tax information are accurate, current, or complete.
- The Service will be uninterrupted, error-free, or free of viruses or other harmful components.
- Any results obtained from the Service will be accurate or reliable.
All data provided by the Service is for general research and planning purposes only. Costs, visa rules, tax treaties, and exchange rates change frequently and may not reflect current conditions.
6. Limitation of Liability
To the maximum extent permitted by applicable law, RetireSmart AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to reliance on cost estimates, visa information, or tax guidance provided by the Service.
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
7. Not Professional Advice
Nothing in the Service constitutes financial advice, legal advice, tax advice, immigration advice, or investment advice. RetireSmart AI is not a licensed financial adviser, lawyer, tax professional, or immigration consultant. You should seek independent professional advice before making any retirement or relocation decisions.
8. Intellectual Property
All content, design, code, and data within the Service are the property of RetireSmart AI and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse engineer, scrape, or extract data from the Service in bulk.
- Share, resell, or sublicense Pro account access to third parties.
- Attempt to circumvent any subscription or access restrictions.
10. Third-Party Services
The Service integrates with third-party providers including Stripe (payments) and open exchange rate APIs. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.
11. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada.
